<div style="text-align: justify;"><span style="letter-spacing:-.3pt;"><span style="font-family:B Nazanin;"><span style="font-size:12.0pt;">ایالات متحده آمریکا، پس یازده سپتامبر 2001 در سودای دستیابی به جایگاه هژمونیک، از طریق نهادینهسازی استثنائات جدیدی نظیر مبارزه با تروریسم، مداخله بشردوستانه و مسئولیت حمایت، به پایهریزی قوانین مطلوب خود در عرصه بینالمللی پرداخت. درواقع، ایالاتمتحده آمریکا از ظرفیت هنجارسازی و قاعدهسازی حقوق بینالملل در راستای تأمین منافع و تحمیل اراده خود بهره گرفت. این تحقیق به چگونگی نقشآفرینی ایالاتمتحده آمریکا در توسعه هنجاریهای حقوق بینالملل خواهد پرداخت. فرضیه این مقاله با تمرکز بر حقوق بینالملل مبارزه با تروریسم و با روش تاریخی ـ تطبیقی و از طریق استدلال<strong></strong></span>های استنادی ـ حقوقی و همچنین استفاده از منابع کتابخانهای، آن است که ایالاتمتحده- بهعنوان کنشگر غالب سیستم بینالملل ـ درصدد تبدیل ترجیحات خود به هنجارها و تعهدات حقوقی جدید از طریق قطعنامههای شورای امنیت، ذیل فصل هفتم منشور ملل متحد پس از حوادث یازده سپتامبر بوده است. در این فرایند میزان تأثیرگذاری یکجانبهگرایی ایالاتمتحده در تحول هنجارهای حقوق بینالملل توسل بهزور با تمرکز بر مبارزه با تروریسم نیز مورد ارزیابی قرار میگیرد.</span></span><span style="letter-spacing:-.3pt;"><span style="font-family:B Nazanin;"><span style="font-size:12.0pt;"></span></span></span></div>
After the 11th of September of 2001, the United States, intending to reach a hgemonic position by institutionalizing new exceptions such as the fight against terrorism, humanitarian intervention, and liability for protection, has established its own international law. In fact, the United States used the capacity to regulate and regulate international law in order to secure its interests and impose its will. This study search the question: how has the United States, played a role in developing the norms of international law. The hypothesis of this article focuses on the international rights of the fight against terrorism and through historical-comparative methods and through citation-legal arguments, as well as the use of library resources. The new law, through Security Council resolutions, follows Chapter VII of the UN Charter after the events of 9/11. In this process, the impact of the unilateralism of the United States on the evolution of the norms of international law is also assessed, focusing on the fight against terrorism.
